Welcome to Graphicly ("Graphicly", "we", "us", "our"). Graphicly operates the website graphicly.in and provides digital products and creative resources for graphic designers, video editors, creators and other creative users.

These Terms & Conditions ("Terms") govern your use of the Graphicly website, your customer account, purchases and access to our digital products.

By accessing or using Graphicly, creating an account or purchasing a product, you agree to be bound by these Terms.

2. About Graphicly

Graphicly is a digital-product platform offering creative assets such as Thumbnail PSDs, VFX Packs, GFX Packs and other digital resources intended for graphic designers, video editors, content creators and similar users.

All products available through Graphicly are delivered electronically. We do not normally ship physical products.

3. Eligibility & User Accounts

To purchase products from Graphicly, customers are required to create and maintain a customer account. Guest checkout is not currently available.

You agree to provide accurate and reasonably up-to-date information when creating your account and placing an order.

You are responsible for maintaining the confidentiality of your account credentials and for activities performed through your account.

If you believe that someone has obtained unauthorized access to your account, please contact Graphicly support promptly.

4. Products & Product Information

We make reasonable efforts to provide accurate product titles, descriptions, previews, file details and other information on our website.

However, digital products may vary in appearance depending on software, screen settings, operating systems, versions and other technical factors.

You should review the product description and available previews before completing your purchase.

Product availability, pricing, features and included files may be changed or updated from time to time.

5. Purchasing Digital Products

You may purchase products available on Graphicly by selecting the desired product and completing the checkout process.

Before payment is completed, you should review the selected product, quantity and applicable price.

An order is considered successfully completed only after the payment has been successfully processed and the order has been recorded by our system.

6. Pricing & Payments

Product prices displayed on Graphicly are shown at the time of purchase and may be changed at any time before an order is completed.

Payments are processed through Razorpay. Depending on availability, customers may be able to pay using methods such as UPI, debit cards, credit cards, net banking and other payment options supported by the payment provider.

Graphicly does not intentionally store complete payment credentials such as your full card number, CVV or banking password on its own website servers.

7. Digital Product Delivery

Graphicly provides digital delivery rather than physical delivery.

After successful payment, the purchased product may be made available through the website download page. A download link may also be sent to the email address associated with your Graphicly account.

Purchased products may also remain accessible through your Graphicly account, subject to product availability and your account remaining in good standing.

8. Product License

Unless a particular product page states otherwise, products purchased from Graphicly are provided with the usage permissions described on the applicable product page or product documentation.

For Graphicly products covered by our standard license, customers may use the purchased files in their own personal or commercial creative projects.

Any product-specific license shown on a product page will take priority over general license wording where the two conflict.

9. Reselling & Redistribution

Graphicly products may include specific permissions regarding resale or redistribution. Where the applicable product explicitly provides resale or redistribution permission from the Graphicly team, those permissions apply subject to the conditions stated for that product.

Customers must not assume that every Graphicly product automatically includes unrestricted resale rights.

You must follow the license or permissions stated on the relevant product page, product documentation or other applicable terms.

10. Prohibited Use

Unless expressly permitted by the applicable product license, you must not:

• Claim Graphicly's original files as your own original work.
• Use products in a way that violates applicable law or third-party rights.
• Circumvent or remove technical or licensing restrictions.
• Use a product beyond the permissions granted with that product.
• Misrepresent the source or ownership of a Graphicly asset.
• Use Graphicly services for fraudulent or unauthorized activities.

11. Intellectual Property

Graphicly, its branding, website design, logos, original website content and other materials may be protected by applicable intellectual property laws.

Purchasing a digital product does not automatically transfer ownership of Graphicly's website, branding or intellectual property to the customer.

The rights granted to a customer are limited to the license or permissions associated with the purchased product.

12. Refunds & Returns

Because Graphicly sells digital products that can be delivered and accessed electronically, purchases are generally non-returnable and non-refundable.

However, refund requests may be reviewed in appropriate circumstances, including:

• Verified duplicate payments.
• Genuine technical issues that cannot reasonably be resolved.
• A product being materially different from its description.
• Other exceptional circumstances that Graphicly agrees to review.

Graphicly aims to provide helpful customer support for account, payment, product access, download and technical issues.

Support is available through email, WhatsApp and Instagram.

While we aim to respond as quickly as possible, response times may vary depending on the nature and complexity of the request.

14. Website Availability

We aim to keep Graphicly available and functional, but we cannot guarantee that the website will always be available without interruption.

Temporary unavailability may occur because of maintenance, updates, technical problems, hosting issues, security incidents or circumstances beyond our reasonable control.

15. Third-Party Services & Links

Graphicly may use or link to third-party services, including payment providers, communication platforms, hosting providers and social media platforms.

Third-party services operate under their own terms, policies and practices. Graphicly is not responsible for the independent operation, content or policies of third-party services.
